Pháp luật về doanh nghiệp khởi nghiệp sáng tạo tại Việt Nam: Quy định và giải pháp

Abstract

The term “startup” is officially defined in the Law on Support for Small and Medium-sized Enterprises in 2017. The activity of startup innovation is becoming increasingly popular with various diverse forms and is receiving much attention and expectation in enterprise development policies. Therefore, the documents of the XIII National Party Congress set out the requirement to “build and perfect the legal framework, experiment with mechanisms, and specific policies to promote... startup innovation” to “develop and enhance the effectiveness of the innovative startup ecosystem, with enterprises at the center”. However, in Vietnam, many people still do not have a clear understanding and identification of this type of enterprise. Therefore, the article focuses on clarifying (1) Perspectives on startup innovation enterprises; (2) Characteristics and criteria for identifying startup innovation enterprises; (3) The current legal situation regarding support for startup innovation enterprises; and (4) Some obstacles and recommendations for improving the legal framework supporting startup innovation enterprises.
