The impact of artificial intelligence technology on determining inventorship from legal perspective

Abstract: The advancement of artificial intelligence technology has introduced significant challenges in determining inventorship under current legal frameworks. International legal systems, including the European Patent Convention and the United States Patent Act (35 U.S.C.), mandate that inventors must be natural persons, primarily to protect human personal and intellectual property rights. However, the increasing involvement of artificial intelligence in the inventive process has raised complex questions regarding patent ownership and the determination of inventorship. This study explores the theoretical foundations of inventorship, examines the implications of artificial intelligence’s role in the patenting process, and, drawing on the experiences of the European Union and the United States, offers policy recommendations for Vietnam.
